In North Carolina, a workers’ compensation claim can be denied for various reasons. One of the two most common factors is the lack of credibility of the witness, or there were no witnesses present when the worker suffered an injury.

When the injured worker is the only witness to the event that resulted in the work accident, he or she must testify before the Industrial Commission – also known as the deputy commission – where the judge makes a decision on the claim. If the deputy commission finds that the injured person is not a credible source, then the worker’s benefits cannot be awarded.

The other most common reason benefits are denied at the deputy commission is when the proposed claim lacks causation between the accident and injury. A health care physician must testify that the accident had caused the injury that is preventing the injured employee from working.
